The Office of the Clerk of Superior Court is an elected office. As a registered voter, you elect the Clerk of Superior Court to oversee the proper registration and retention of important documents in civil and criminal proceedings the Superior Court of Lumpkin County including various other vital records of importance such as real estate transactions of property located within Lumpkin County. Generally, most records from 1833 to the present are available in our office.

The office of the Clerk of Superior Court consists of four major divisions: the Judicial Division, the Real Estate Division, the Personal Property/ Liens/Accounting Division, and the Business/Professional/Administrative Division.


The Judicial Division

The Judicial Division is responsible for receiving, filing, computerizing, processing, storing, and retrieving civil and criminal records for the courts of Lumpkin County. This division provides support for all court judges through the management of case files and attendance in court. You may obtain copies of or records including, but not limited to, the following documents:

I. Civil Case Files

- General Civil Cases
- Domestic Civil Cases
- Name Change Petitions
- Legitimization Petitions
- Condemnation Petitions
- Modification Petitions
- Contempt Petitions

II. Criminal Indictments and Accusations

III. Subpoenas

The Real Estate Division

The Real Estate Division is responsible for receiving, recording, indexing and microfilming all documents related to real estate within Lumpkin County. You may receive copies of or records including, but not limited to, the following documents:

I. Real Estate Deeds

- Warranty/Security/Quit Claim Deeds
- Deeds of Assent /Deeds of Gift/Guardian Deeds
- Deeds Under Power of Attorney
- Sheriff's Deeds/Tax Deeds
- Right of Way Deeds/ Testamentary Deeds/Trust Deeds

II. Miscellaneous Real Estate

- Affidavits/Agreements/Amendments
- Assignments
- Cancellation of Security Deeds
- Plats/Covenants/Declarations
- Easements/Liens/Modification Agreements
- Powers of Attorney
- Timber Agreement Transfers/Trust Agreements

The Personal Property, Liens, and Accounting Division

The Uniform Commercial Code (U.C.C.) section is responsible for the recording, processing, indexing, and microfilming of records serving as public notice that personal properties located within Lumpkin County
(equipment, furnishings, etc.) have outstanding liens against them. The accounting section is responsible for the accounting business of the Clerk's office and for payment of funds into the court registry. This division is also responsible for General Executions/Liens (documents directing the Sheriff to seize properties to satisfy a judgment). You may obtain copies of or records including, but not limited to, the following documents:

I. Personal Property Records

- Uniform Commercial Code Financing Statements(UCC)
- Release of Financing Statements
- Partial Release of Financing Statements
- Termination, Amendments, and Continuation of Financing
   Statements

II. Liens

- Writ of Fieri Facias (FIFA)
- Hospital Lien
- Lis Pendens
- State Tax FiFa/County Tax FiFa/Federal Tax FiFa
- Miscellaneous Lien

The Business, Professional, and Administrative Division  

The Business/Professional/Administrative Division is responsible for the recording, processing, indexing and reproduction of all documents related to BPA. In BPA you can register a Trade Name of a business, file papers for general partnership, or apply for notary public commission. Court calendars, Search Warrants, and Indigent Defense information are also recorded the BPA.

Locating Records in the Clerk's Office...

Judicial Records

To locate records it is extremely helpful for you to have the 
following information prior to your arrival in our office:

- The name of plaintiff or defendant
- The date the case was filed.

You will use this information to search the court index to find a case number. Indexes for civil and criminal cases are located in the record room. Employees of the Clerk's Office are available to assist you if needed.

Real Estate Records

To locate real estate records it is very helpful to have the following information prior to your arrival in our office:

- The buyer's name
- The seller's name
- The date of the transaction

You will use this information to search the real estate index to find a book and page number. Real Estate indexes are located in the record room. They are entitled Grantor/Grantee Index and are divided by
calendar years. Once a bookand page number is found you will pull the book from the shelf and find the page number. Employees of the Clerk's Office are available to assist you if needed.

Business / Professional / Administrative Records

To locate records on the Business/Professional/Administrative Docket such as trade names, charters, limited partnerships, general partnerships, and notary p0lics it is extremely helpful to have the following information prior to your arrival in our office:

- TRADE NAMES -- name of the business 
- DD-214/DISCHARGE CERTIFICATE FROM MILITARY -- the full name of the veteran and date of discharge
- LIMITED/GENERAL PARTNERSHIPS -- name of the partnership
- NOTARY PUBLIC -- name of the notary and date of commission

You will use this information to search the indexes provided for these documents to find  book and page or document number. Employees of the Clerk's Office are available to assist you if needed.

General Execution/Lien Records

To locate General Execution/Lien Records it is very helpful to have the following information before your arrival in our office:

- Name of the plaintiff or defendant and the date of judgment.

You will use this information to search the General Execution/Lien index for these documents to find a book and page number. Employees of the Clerk's Office are available to assist you if needed.
